CCXPRESS Freight Less-than-Truckload (LTL) Transportation Services Terms & Conditions

Overview: CCXPRESS Freight LTL transportation services are provided by TFI International Inc., including its affiliates, divisions, or subsidiaries (such as TForce Freight), and are not affiliated with Cross Country Xpress, Inc. or its related entities (“CCXPRESS”). CCXPRESS assumes no liability for any services provided by TFI International Inc. or its affiliates, subsidiaries, or divisions.

Terms & Conditions of Carriage

These Terms and Conditions form the basis of the shipping contract between the shipper and CCXPRESS and govern the general terms and conditions under which CCXPRESS transports packages and palletized goods, both within its own territory and through interchange with affiliated carriers.

1. Introduction

A. Scope of Terms
These terms outline the conditions under which CCXPRESS will transport packages, documents, and envelopes (“packages”) and palletized goods (“pallets”). Both packages and pallets are collectively referred to as “shipments.” These Terms are supplemented by the current CCXPRESS Service and Tariff Guides (“the Guide”), which contain important details about CCXPRESS services and form part of the agreement between the shipper and CCXPRESS. The shipper should carefully read and understand the Guide.

B. Applicable Carrier
Depending on the location where the shipment is presented to CCXPRESS, the following entities are considered the applicable carriers:

  • UK: CCXPRESS Limited
  • Ireland (Eire): Cross Country Xpress of Ireland Limited
  • Denmark: CCXPRESS Denmark A/S
  • Finland: Cross Country Xpress Finland Oy
  • Norway: CCXPRESS of Norway, Inc.
  • Sweden: Cross Country Xpress Sweden AB

All of these entities can be contacted through Avenue Ariane 5, 1200 Brussels, Belgium, unless otherwise stated.

C. Applicable Conventions
When international air carriage is involved, and the ultimate destination is outside the country of origin, the Warsaw Convention may apply, governing and limiting the carrier’s liability regarding loss, damage, or delay to cargo. This includes the Convention for the Unification of Certain Rules Relating to International Carriage by Air (1929), its amendments, or the Montreal Convention 1999. Similarly, international road transport may be subject to the CMR Convention (Convention on the Contract for the International Carriage of Goods by Road, 1956).

D. Intermediate Stops and Subcontractors
Shipments may be routed through intermediate stops at CCXPRESS’s discretion. CCXPRESS may also engage subcontractors to perform services under its contracts, who will benefit from these Terms.

E. Waybill Definition
The term “Waybill” refers to a CCXPRESS consignment note or a record of shipments associated with a specific service level, address, and date. All shipments covered by a Waybill are considered a single shipment.

2. Scope of Service

Unless specifically agreed otherwise, CCXPRESS’s services include the collection, transportation, customs clearance (where applicable), and delivery of shipments. The shipper acknowledges that shipments may be consolidated with those of other shippers during transit. Additionally, CCXPRESS does not guarantee individual monitoring of shipments at all handling centers.

CCXPRESS is not a common carrier and reserves the right to refuse the carriage of any shipment at its sole discretion.

3. Conditions of Carriage

This section outlines restrictions and conditions that apply to the carriage of shipments by CCXPRESS. It also addresses the consequences when a shipment does not meet the required criteria for carriage.
